1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of dustygearco.com (the "Site") and any purchase you make from Dusty Gear Co. ("Dusty Gear Co.," "we," "us," or "our"). By browsing the Site, creating an order, or otherwise using our services, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

We may update these Terms from time to time. Changes take effect once posted to this page; continued use of the Site after a change means you accept the updated Terms.

2. Eligibility

You must be able to form a legally binding contract to use the Site and place an order. By placing an order, you represent that you are at least 18 years old, or are using the Site under the supervision of a parent or legal guardian.

3. Products and Print-on-Demand Orders

All apparel sold by Dusty Gear Co. is produced using direct-to-film (DTF) printing on a made-to-order basis. Because items are printed specifically for each order:

Colors, print placement, and garment shade may vary slightly from what's shown on screen due to monitor settings and the print process.
Orders typically enter production shortly after purchase. Once production has started, an order can no longer be changed or canceled.
We reserve the right to limit quantities, refuse an order, or discontinue a product design at our discretion.

4. Pricing and Payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, even after an order has been placed, and will contact you before charging a corrected amount. Payment is processed securely through Shopify's checkout system at the time of purchase; we do not store your full payment card details.

5. Shipping

We currently ship within the United States. Estimated production and delivery times are provided at checkout and are estimates only, not guarantees. Dusty Gear Co. is not responsible for delays caused by the carrier, customs, weather, or other events outside our control. Risk of loss and title for products pass to you upon our delivery to the carrier.

6. Returns, Refunds, and Store Credit

Returns, refunds, and store credit are governed by our Return and Refund Policy, which is incorporated into these Terms by reference. In summary: eligible unworn, unwashed items may be returned within 30 days of delivery for store credit; defective, damaged, or incorrect items are eligible for a free replacement or full refund.

7. Intellectual Property

All content on the Site — including designs, graphics, logos, product images, and text — is the property of Dusty Gear Co. or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content or product design without our prior written permission.

Purchasing a product does not transfer any ownership of the underlying design or artwork to you; it grants you the right to use the physical item you purchased.

8. User Conduct

When using the Site, you agree not to:

Use the Site for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorized access to the Site, our systems, or other users' accounts.
Upload or transmit viruses, malicious code, or engage in any activity that disrupts the Site's operation.
Use automated means (bots, scrapers) to access the Site without our written permission.
Submit false or fraudulent orders, or engage in chargeback abuse.

We may suspend or terminate your access to the Site at our discretion if we believe you've violated these Terms.

9. Third-Party Services

Our Site uses third-party services, including Shopify for e-commerce hosting and payment processing. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, Dusty Gear Co. and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products, even if advised of the possibility of such damages. Our total liability for any claim arising from your order will not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold Dusty Gear Co. harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

14. Changes to These Terms

We may revise these Terms at any time by updating this page. It's your responsibility to review these Terms periodically. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
